These Terms & Conditions govern the use of the LYOR website and the purchase of products from LYOR MANUFAKTUR AG.
By placing an order with LYOR, the customer confirms that they have read, understood and accepted these Terms & Conditions, together with the applicable Privacy Policy, Shipping Policy and Refund & Return Policy.

2. SCOPE
These Terms & Conditions apply to purchases made through the LYOR website and, where expressly referenced, orders placed directly with LYOR, including personalized and individually configured timepieces.
Additional or specific conditions may apply to certain products, services, limited creations, special commissions or personalized orders.
3. PRODUCTS
LYOR makes reasonable efforts to present its timepieces, materials, colors, dimensions and specifications as accurately as possible.
However, photographs, videos and digital representations are provided for illustrative purposes.
Colors and visual appearance may vary depending on lighting, photography, screen settings and the natural characteristics of materials.
Minor variations resulting from materials, manufacturing, finishing or assembly do not necessarily constitute defects.
LYOR reserves the right to modify product specifications, components, finishes or packaging where reasonably necessary, provided that such modifications do not materially reduce the essential characteristics of the product purchased.
4. PERSONALIZATION & CONFIGURATION
Certain LYOR timepieces offer personalization possibilities, including combinations of:

-
Colors
-
Finishes
-
Materials
-
Other available configuration elements
The customer is responsible for carefully reviewing and confirming their selected configuration before placing the order.
Once a personalized order has entered preparation, assembly or production, changes or cancellations may no longer be possible.
Variations in color, texture or appearance resulting from materials, production processes or screen representation do not necessarily constitute defects.
Personalized or individually configured products cannot be returned or exchanged solely because the customer changes their preference, subject to mandatory applicable law.
5. ORDERS
Submitting an order does not necessarily constitute final acceptance by LYOR.
LYOR reserves the right, where legally permitted, to accept or decline an order, including in cases involving:

Product unavailability

Incorrect pricing
-
Technical errors
-
Suspected fraud
-
Payment issues
-
Incomplete customer information
-
Delivery restrictions
-
Compliance or security concerns
A binding sales contract is concluded in accordance with the ordering process communicated by LYOR and applicable law.
Customers will receive an electronic confirmation of their order.
6. PRICES
Prices are displayed in the currency indicated on the website.
Prices applicable to an order are those displayed and confirmed during the checkout process, subject to correction of obvious errors where legally permissible.
Shipping charges and other applicable costs will be indicated as required during the ordering process.
For international deliveries, customs duties, import VAT, customs clearance charges and other local taxes may apply and remain the responsibility of the recipient unless LYOR expressly states otherwise.
7. PAYMENT
Orders must be paid using one of the payment methods made available by LYOR.
LYOR may use independent payment service providers to process transactions.
An order may be suspended or cancelled if payment is refused, reversed, disputed or identified as potentially fraudulent.
The customer confirms that they are authorized to use the selected payment method.
8. FRAUD & SECURITY
LYOR reserves the right to conduct reasonable verification procedures before accepting or shipping an order.
For high-value transactions, LYOR may request additional verification where reasonably necessary to prevent fraud, unauthorized transactions or identity misuse.
LYOR may refuse or cancel an order where there are reasonable grounds to suspect fraud, unlawful activity or unauthorized payment.
9. SHIPPING & DELIVERY
Orders are shipped according to the applicable LYOR Shipping Policy.
Delivery times communicated by LYOR are estimates unless expressly guaranteed in writing.
LYOR is not responsible for delays caused by circumstances outside its reasonable control, including carrier disruptions, customs procedures, strikes, severe weather, governmental measures or other force majeure events.
The customer is responsible for providing accurate and complete delivery information.
10. TRANSFER OF RISK & OWNERSHIP
Ownership of a product remains with LYOR until the purchase price has been paid in full, to the extent permitted by applicable law.
Transfer of risk relating to delivery will be determined in accordance with applicable law and the agreed shipping arrangements.
Nothing in these Terms limits mandatory consumer rights concerning delivery or risk transfer.
11. INSPECTION UPON DELIVERY
Customers are requested to inspect their order promptly after delivery.
Visible transport damage should be documented and reported to LYOR as soon as reasonably possible, preferably within 48 hours, together with photographs of the product, packaging and shipping box.
This requested notification period does not exclude mandatory legal rights relating to defects that could not reasonably have been discovered within that period.
12. RETURNS & REFUNDS
Returns, exchanges and refunds are governed by the applicable LYOR Refund & Return Policy.
Unless otherwise required by applicable law, LYOR does not provide a general return or cancellation right simply because a customer changes their mind.
Personalized and individually configured products are generally considered final sales once preparation or production has begun, subject to mandatory applicable law.
13. WARRANTY & DEFECTS
Every LYOR timepiece undergoes quality control before shipment.
If a timepiece presents a suspected manufacturing or material defect, the customer must contact LYOR as soon as the defect is discovered.
LYOR may require the timepiece to be returned for technical inspection before determining the appropriate remedy.
To the extent permitted by applicable law and the applicable warranty conditions, LYOR may determine whether an eligible defect should be addressed through repair, replacement or another appropriate remedy.
Mandatory statutory rights remain unaffected.
14. WARRANTY EXCLUSIONS
Unless otherwise required by law, warranty coverage does not extend to damage resulting from:

Normal wear and tear

Accidents or impacts
-
Improper use or handling
-
Negligence
-
Unauthorized opening or modification
-
Repairs performed by unauthorized third parties
-
Improper storage
-
Failure to follow care instructions
-
Damage caused by external circumstances
-
Loss or theft
-
Cosmetic deterioration resulting from normal use
Straps and other components naturally subject to wear may have different coverage depending on the nature of the issue.
15. WATER RESISTANCE
Water resistance applies only according to the specifications communicated for the individual LYOR model.
Water resistance is not necessarily permanent and may be affected by aging, impacts, temperature changes, seals, servicing or improper use.
Customers must follow the care and usage instructions provided for their specific timepiece.
16. SERVICING & UNAUTHORIZED MODIFICATIONS
LYOR recommends that servicing and repairs be performed by LYOR or a service provider authorized by LYOR.
Damage resulting from unauthorized repair, modification, opening or intervention may be excluded from warranty coverage to the extent permitted by law.
17. LYOR PASSPORT OF AUTHENTICITY
Certain LYOR timepieces are supplied with a LYOR Passport of Authenticity.
The Passport of Authenticity identifies and accompanies the timepiece according to the information recorded by LYOR.
Alteration, falsification or unauthorized reproduction of a LYOR Passport of Authenticity is prohibited.
Loss of the Passport does not automatically entitle the customer to a replacement.
LYOR may require appropriate verification before issuing any replacement document.
18. INTELLECTUAL PROPERTY
The LYOR name, trademarks, logos, watch designs, product names, photographs, videos, graphics, texts, configurations, packaging elements and other creative materials are protected by applicable intellectual property laws where applicable.
Unless expressly authorized in writing by LYOR, users may not reproduce, copy, distribute, modify, commercially exploit or use LYOR content or intellectual property for commercial purposes.
Nothing on the LYOR website grants any license or right to use LYOR intellectual property except as necessary for ordinary personal use of the website.
19. COUNTERFEITING & UNAUTHORIZED COMMERCIAL USE
LYOR reserves all rights available under applicable law against counterfeiting, unauthorized reproduction, misleading use of LYOR trademarks, unauthorized commercial exploitation or other infringement of its intellectual property.
20. WEBSITE INFORMATION
LYOR makes reasonable efforts to ensure that information published on its website is accurate and current.
However, technical errors, typographical errors or temporary inaccuracies may occur.
LYOR reserves the right to correct such errors and update website content where legally permissible.
21. WEBSITE AVAILABILITY
LYOR does not guarantee uninterrupted or error-free access to its website.
Access may temporarily be suspended for maintenance, security, technical reasons or circumstances outside LYOR's reasonable control.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, LYOR shall not be liable for indirect, incidental or consequential losses arising from the use of its website or products where such liability may legally be excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability arising from intentional misconduct or gross negligence where such exclusion is prohibited.
23. FORCE MAJEURE
LYOR shall not be responsible for delay or failure to perform obligations caused by events outside its reasonable control, including natural disasters, war, terrorism, epidemics, governmental measures, transportation disruptions, strikes, customs delays, supply-chain interruptions, power failures or major technical incidents.
Where such circumstances occur, LYOR may reasonably extend performance times or take other appropriate measures.
24. THIRD-PARTY SERVICES
The LYOR website may rely on or link to third-party services, including payment providers, shipping providers, social networks or other technology services.
LYOR is not responsible for the independent content, systems, availability or privacy practices of third-party services outside its reasonable control.
25. PRIVACY
Personal data is processed according to the LYOR Privacy Policy and applicable data protection legislation.
26. CUSTOMER RESPONSIBILITY
Customers are responsible for:

Providing accurate information

Selecting the correct product and configuration

Reviewing personalization choices before confirming an order

Providing a valid delivery address

Following care and operating instructions

Keeping order and authenticity documentation secure
27. RESALE
Unless otherwise agreed in writing, the purchase of a LYOR timepiece does not create any commercial partnership, dealership, distribution right or authorization to represent LYOR.
Any commercial resale or representation using LYOR trademarks must comply with applicable law and any contractual restrictions validly agreed with LYOR.
28. NO WAIVER
If LYOR does not immediately exercise a contractual or legal right, this does not mean that LYOR has waived that right.
29. SEVERABILITY
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
The invalid provision shall, where appropriate and legally permissible, be replaced or interpreted in a manner that most closely reflects its intended lawful purpose.
30. CHANGES TO THESE TERMS
LYOR may update these Terms & Conditions from time to time.
The version applicable to a purchase is generally the version made available to the customer at the time the relevant order is concluded, subject to mandatory applicable law.
31. GOVERNING LAW
These Terms & Conditions and contractual relationships with LYOR are governed by Swiss law, subject to any mandatory consumer protection rules or conflict-of-law provisions that apply to a particular customer.
32. JURISDICTION
Subject to mandatory jurisdiction rules applicable to consumers, disputes relating to these Terms & Conditions or purchases from LYOR shall be subject to the competent courts determined under applicable Swiss law.
Nothing in this clause deprives a consumer of a mandatory place of jurisdiction available under applicable law.
33. ENTIRE AGREEMENT
These Terms & Conditions, together with the applicable order confirmation, product information, Refund & Return Policy, Shipping Policy, Privacy Policy and any specific written terms agreed by LYOR, constitute the contractual framework applicable to the purchase.
